Operator and acceptance
Brown Virtual Lab is organized by Dr. Sherry-Ann Brown, MD, PhD, FACC, FAHA, and operated for research, innovation, education, and collaboration by My Heart Opulence LLC dba Heart Innovation & Equity Research Institute. Access or use signifies acceptance of these Terms, the Privacy Policy, Cookies Policy, and every activity-specific agreement presented for acceptance.
Purpose
Brown Virtual Lab supports research development, scholarship, mentorship, methods, innovation, writing, publication, professional development, public knowledge, and cross-institutional collaboration. Each institutional hub retains its own authority, supervision, ethics obligations, data responsibilities, and local decisions.
Professional and research boundaries
Site materials provide educational and scholarly information. Medical care, diagnosis, treatment, legal advice, financial advice, institutional approval, research ethics approval, and regulatory authorization require the appropriate professional or institutional pathway.
General Site access and collaboration intake remain distinct from formal research participation. Human-subjects activity proceeds through the applicable protocol, institutional authorization, ethics review, privacy review, data-use terms, and informed consent.
Account and participation duties
Users provide accurate information, protect account access, follow role limits, maintain professional conduct, respect intellectual contributions, honor confidentiality, and use materials only within authorized purposes.
Participation creates a scholarly collaboration relationship governed by the applicable written terms. Employment, compensation, authorship, publication, academic credit, funding, partnership, agency, fiduciary duty, and ownership arise only through an authorized written decision or agreement that expressly grants them.
Information boundary
Protected health information, identifiable patient or research-participant information, confidential datasets, authentication secrets, restricted manuscript text, export-controlled information, proprietary third-party material, and information supplied without adequate authority remain within separately approved secure systems and processes.
Public forms receive high-level collaboration and professional information. Authorized administrators use operational summaries and governed references within restricted workspaces.
Intellectual property
The operator owns, licenses, or administers the Site design, original copy, images, templates, workflows, taxonomies, software, research-development materials, learning resources, documentation, and related improvements. Contributors retain rights in original contributions according to applicable law and project-specific agreements.
Authorized users receive a personal, limited, revocable, nonexclusive, nontransferable license for the stated educational and scholarly purpose.
Security and audit records
The Site maintains server-side operational audit records for instrumented activity. Records may include server receipt time, connecting IP address, pseudonymous session identifier, route, component, action, outcome, consent state, browser and device information, referral source, and limited technical metadata. Routine interaction events exclude passwords, authentication secrets, message bodies, and sensitive field contents.
Audit records support delivery, security, troubleshooting, consent provenance, misuse prevention, compliance, policy enforcement, intellectual-property protection, dispute management, and operational integrity. General retention is twenty-four months, subject to legal holds, investigations, claims, and applicable duties.
Availability and enforcement
Features, resources, events, collaboration opportunities, and beta functions may evolve. The operator may investigate misuse, restrict features, suspend access, remove material, preserve evidence, apply a legal hold, or end participation according to safety, integrity, legal, operational, and agreement requirements.
Risk allocation
Services are supplied as available and as provided to the fullest extent permitted by law. Users retain responsibility for independent decisions and qualified review. Liability limitations, indemnification duties, mandatory rights, and jurisdiction-specific exclusions apply according to law and any activity-specific agreement.
Disputes and governing law
The parties proceed through confidential good-faith negotiation, confidential mediation, and confidential binding individual arbitration, with remote, virtual, electronic, and asynchronous proceedings where legally permitted. Jury and class, collective, consolidated, and representative proceedings are waived to the fullest extent permitted by law.
Wyoming law governs these Terms, together with applicable federal law. Ohio is the court venue when a court proceeding remains legally applicable. Urgent provisional relief may be sought for confidentiality, privacy, security, data, and intellectual-property protection where legally available.
